Each Metabiologics product is shipped with documentation stating specifications and other technical information. Metabiologics products are warranted to meet or exceed the stated specifications. Metabiologic's sole obligation and the customer's sole remedy is limited to replacement of products free of charge in the event products fail to perform as warranted.

Metabiologics makes no other warranty of any kind whatsoever, and SPECIFICALLY DISCLAIMS AND EXCLUDES ALL OTHER WARRANTIES OF ANY KIND OR NATURE WHATSOEVER, DIRECTLY OR INDIRECTLY, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, AS TO THE SUITABILITY, PRODUCTIVITY, DURABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, MERCHANTABILITY, CONDITION, OR ANY OTHER MATTER WITH RESPECT TO Metabiologics PRODUCTS.

In no event shall Metabiologics be liable for claims for any other damages, whether direct, incidental, foreseeable, consequential, or special (including but not limited to loss of use, revenue or profit), whether based upon warranty, contract, tort (including negligence) or strict liability arising in connection with the sale or the failure of Metabiologics products to perform in accordance with the stated specifications.

Force Majeure.

The performance of Metabiologics, Inc. of any covenant or obligation on its part to be performed under any agreement with you shall be excused by floods, strikes, or other labor disturbances, riots, fires, accidents, wars, embargoes, delays of carriers, failure of power, or of regular sources of supply, acts, injunctions, or restraints of government, or any other cause preventing such performance, beyond our reasonable control.

Entire Agreement.

This Agreement and associated documents identified herein constitute the entire agreement between Metabiologics, Inc. and you with respect to your use of the Web site, the Service, and your purchase of Products hereunder, except as the foregoing (i) may be amended from time to time by us as provided for above, or (ii) as related to your purchase of Products, may be superseded by any express conflicting terms or supplemented by any express additional terms in a separate written contract signed by authorized representatives of Metabiologics and you.
